These Terms govern your use of this website and describe how Calm Water Development Ltd. (“Calm Water,” “we,” “us”) presents its services online. By using the site, you agree to these Terms.

What we do. We provide professional web design, development, and related consulting. Specific scope, fees, timelines, and deliverables for paid work are defined only in separate written agreements (proposals, statements of work, or order forms)—not by marketing copy alone.

Information on this site. Content here describes our capabilities in general terms. It is not a guarantee of results, availability, or pricing for any particular project until confirmed in writing.

Payments. When you purchase through the site, transactions may be processed by third-party providers (such as Stripe). Their terms and privacy notices apply to payment processing.

Intellectual property. The site, its design, branding, and our pre-existing tools and libraries remain our property or that of our licensors. Rights to custom work product for clients are set out in your project agreement.

Acceptable use. Do not misuse the site—no unlawful activity, attempts to disrupt or probe systems, or use that harms others.

Disclaimer. The site is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim warranties not expressly stated here. Some jurisdictions do not allow certain disclaimers; in those cases our liability is limited to the fullest extent permitted.

Limitation of liability. To the maximum extent permitted by applicable law, Calm Water is not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of this site or reliance on its content, or for any loss of data or profits—even if we were advised of the possibility. Our total liability for any claim relating to this website (other than liability that cannot be excluded under applicable law) is limited to the greater of one hundred Canadian dollars (CAD $100) or the fees you paid us for services in the twelve months before the claim.

Governing law. These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict-of-law rules. You agree to the exclusive jurisdiction of the courts located in British Columbia, subject to mandatory protections that apply to you.

Changes. We may update these Terms from time to time. Continued use after updates constitutes acceptance of the revised Terms.
